Arbitration, Class Action Waiver, Jury Waiver
Please carefully read the following as it outlines the agreement between you and Find A Local PI to resolve all disputes through binding individual arbitration.
- Applicability: You and Find A Local PI agree that all claims and disputes, including contractual, tort, or statutory claims related to these Terms or the use of the Services, will be resolved by binding arbitration on an individual basis. Disputes involving equitable relief for alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents are exempted from arbitration.
- Arbitration Rules: Arbitration will be governed by the Federal Arbitration Act. The arbitral forum's rules will apply. Non-appearance-based arbitration may be utilized for claims under USD 10,000.
- Fees: The applicable fee schedule applies, with Find A Local PI covering arbitration costs if it initiates the arbitration. If you initiate arbitration, you will pay the first $100 of the initial filing fee, while Find A Local PI will cover the remainder and both parties' administrative fees.
- Authority of the Arbitrator: The arbitrator has jurisdiction to decide disputes and grant relief as per law and these Terms. The decision is final and binding.
- Waiver of Jury Trial: Both parties waive the right to a trial by jury and agree to resolve disputes through arbitration.
- Waiver of Class or Consolidated Actions: All disputes must be arbitrated or litigated individually; class or consolidated actions are not permitted.
- Opt-out: You have the option to opt out of this Arbitration Agreement within 30 days of becoming subject to it by notifying Find A Local PI in writing.
- Small Claims Court: Either party may bring an individual action in small claims court.
- Survival: This Arbitration Agreement remains in effect after the termination of your relationship with Find A Local PI.
Prepaid Balances, Top-Ups, and Automatic Reup (Lead Buyers)
Buyers who purchase leads through Find A Local PI may maintain a prepaid balance. Each lead purchased is debited from that balance. If a buyer enables budget controls, lead delivery stops automatically when the balance is insufficient to cover the price of a lead.
A buyer may add funds through a one-time top-up or by enabling automatic reup. By enabling automatic reup, the buyer authorizes Find A Local PI to charge the payment method on file to add the buyer-specified amount to their balance when it falls below the buyer-specified threshold, so that lead delivery continues without interruption. The buyer represents that they are authorized to use that payment method. Prepayments are applied to future lead purchases and are non-refundable except as required by the buyer agreement or applicable law. A buyer may turn off automatic reup at any time in their portal billing settings; turning it off may pause lead delivery once the balance is depleted. Find A Local PI records each such authorization and revocation, including the terms presented, the date and time, and the originating IP address and device, as a record of consent.
Data Sharing and Disclosure
Subscriber information will not be shared or sold to third parties or affiliates for their direct marketing and promotional purposes. No mobile information will be shared or sold to third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
